Texas law permits spouses to divorce under limited circumstances. A court may grant a divorce on any of three "no-fault" grounds:
- the spouses have lived apart for three years,
- one spouse has been confined in a mental hospital for three years, or
- insupportability (that is, conflict or discord between the spouses prevents reconciliation).
The court will also grant a divorce based on the following "fault" grounds: cruelty, adultery, the respondent's felony conviction, or the respondent's abandonment of the petitioner for one year.
While you cannot prevent your spouse from divorcing you in Texas, you can have a say in the legal issues that come up concerning child custody and support, spousal support, and division of property accumulated during the marriage ("community property").
