Temporary Orders
JT Borah assists and advises clients living in Denton County on family law matters relating to temporary orders. A temporary order is a court order that protects you, your family members, or your property from being moved, changed or transferred while the court resolves a larger action. Temporary Orders may be granted by a Texas Court in a divorce proceeding, or in a Suit Affecting the Parent-Child Relationship (SAPCR), such as a custody, support, or visitation matter.
While a divorce lawsuit is pending, the parties may request many types of relief relating to their property and protection from the Court, and the Court may grant the requested relief as deemed equitable (fair) and necessary. On the motion of a party, or on the Court's own motion after notice to the other party and a hearing, the Court may issue an appropriate order, including:
- Temporary injunctions for the preservation of assets and protection of the parties;
- Temporary spousal support;
- Temporary orders for the payment of community debt;
- Interim attorney's fees;
- Discovery orders, including an order setting the deadline for the filing of the parties' sworn inventories; or
- Orders for appraisal of assets.
As it relates to children, in a divorce proceeding or a SAPCR, the Court may make or modify a temporary order for the safety and welfare of the child, including orders:
- For the temporary conservatorship of the child;
- For the temporary support of the child;
- Restraining a party from disturbing the peace of the child or another party;
- Prohibiting a person from removing the child beyond a geographical area identified by the Court; or
- For payment of reasonable attorney's fees and expenses.
